Definitions
“Membership” means a recurring Race Pro subscription offered by Max Out Australia. “Member” means the person who purchases or receives a Membership. “Promotion” means an eligible giveaway conducted by Max Out Australia. “Account” means the Member’s online account. “Website” means www.maxoutaustralia.com.au.
Acceptance of Terms
By purchasing or accepting a Membership, you agree to these Race Pro Membership Terms & Conditions, the Max Out Australia General Terms & Conditions and Privacy Policy.
Eligibility
Memberships are available only to Australian residents aged 18 years or over. Residents of South Australia (SA) and the Australian Capital Territory (ACT) are not eligible to participate in promotions unless otherwise stated.
Membership Benefits
Active Members automatically receive the number of entries allocated to their Membership tier, as advertised on the Website, into eligible promotions while their Membership remains active and in good standing. Benefits are personal and cannot be transferred, assigned, exchanged or redeemed for cash.
Billing & Renewals
Memberships are recurring monthly subscriptions. By purchasing a Membership, you acknowledge and authorise Max Out Australia to automatically charge your nominated payment method each month until the Membership is cancelled.
Failed Payments
If a scheduled payment cannot be processed, Membership benefits may be suspended until payment is successfully received. If payment is not successfully received before a promotion closes, no entries will be allocated for that promotion. Max Out Australia may retry failed payments where permitted by law.
Cancellation
Members may cancel their Membership at any time through their account dashboard or by contacting Max Out Australia. Upon cancellation, the Membership immediately ceases and all entries issued through that Membership, including previously allocated entries, become void and are removed from all current and future promotions. Cancellation prevents future recurring charges. Membership fees already paid are non-refundable except where required by Australian Consumer Law.
Complimentary Memberships
Complimentary or promotional Memberships awarded by Max Out Australia are non-transferable, cannot be redeemed for cash or credit and expire automatically at the end of the promotional period unless otherwise advised.
Refunds
Membership payments are generally non-refundable once processed except where required by Australian Consumer Law.
Membership Changes
Max Out Australia may amend Membership pricing, features or benefits from time to time. Any material changes will be published on the Website before taking effect where required.
Suspension or Termination
Max Out Australia may suspend or terminate a Membership where fraudulent activity, chargebacks, payment disputes, misuse of the Membership program, breach of these Terms, unpaid fees or conduct that may compromise the integrity of a promotion is reasonably suspected.
Giveaway Conditions
Holding a Membership does not guarantee a prize. Each promotion is conducted under its own published Terms & Conditions. If there is any inconsistency between these Membership Terms and an individual promotion’s Terms & Conditions, the promotion Terms & Conditions prevail.
Privacy
Personal information is collected, stored and handled in accordance with the Max Out Australia Privacy Policy.
Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
Amendments
Max Out Australia may update these Terms at any time by publishing the revised version on the Website. Continued use of a Membership constitutes acceptance of the updated Terms.
